On October 16, 1859, John Brown led an unsuccessful raid on the Harpers Ferry Armory. He planned to seize the cache of weapons in order to arm local slaves, to march south, and to deplete Virginia of the slaves who supported its economy. While it failed to realize this objective, the raid succeeded in driving a wedge between the Union and the Confederate States. The rift that Brown helped create grew into the gaping wound of the Civil War.Four years later, (...) Abraham Lincoln surveyed the site of the most gruesome aspect of that wound: Soldier's Cemetery at Gettysburg, Pennsylvania. A lecturer and Unitarian minister, Parker was also a social reformer and an articulate critic of American culture. Collins’ selections from Parker’s writings reflect the breadth of his concerns. Michael Rosen’s The Shadow of God includes an account of historical theodicy, which is the idea that the arc of history justifies the ways of God. Formulated by the German Idealists, its American expositors influenced the ideas of the nineteenth-century American theologian and activist Theodore Parker. As the orginator of the phrases “arc of history” and “government of the people, by the people, and for the people,” Parker’s influence extends to presidents and Supreme Court justices, demonstrating the (...) long and influential afterlife of the German philosophical discourses that Rosen explores. But examining this afterlife also challenges the assumption that we can discern the arc of history without the monotheistic presuppositions present in Parker. (shrink)

Martin Luther King, Jr., quoting the 19th-century clergyman Theodore Parker, claimed that the arc of the moral universe “bends toward justice.” One hopes he is right, perhaps especially at times when history appears to have taken something of a detour. At a moment when the requirements of belief and unbelief were being negotiated in unexpected ways, transcendentalism allowed for a more creative approach to spiritual questions. Interrogating the movement's alleged atheistic underpinnings, David Faflik contends that transcendentalism reconstituted the religious sensibilities of 1830s and 1840s New England, producing a dynamic and complex array of beliefs and behaviors that cannot be categorized as either religious or nonreligious. Transcendental Heresies draws on an expansive antebellum archive of period commentary and writings by transcendentalism's practitioners, including Ralph Waldo Emerson, Henry David Thoreau, Theodore Parker, Margaret Fuller, and the women of transcendentalism's second and third waves. From Boston to Concord to the heady environs of Harvard, the species of unbelief they practiced multiplied the religious possibilities of the era, expressing misgivings about traditional notions of divinity, flouting religion's customary forms, and ultimately encouraging spiritual questioning. Transcendentalism is an American literary, political, and philosophical movement of the early nineteenth century, centered around Ralph Waldo Emerson. Other important transcendentalists were Henry David Thoreau, Margaret Fuller, Amos Bronson Alcott, Frederic Henry Hedge, and Theodore Parker. Stimulated by English and German Romanticism, the Biblical criticism of Herder and Schleiermacher, and the skepticism of Hume, the transcendentalists operated with the sense that a new era was at hand. They were critics of their contemporary society for its unthinking conformity, (...) and urged that each individual find, in Emerson's words, “an original relation to the universe”. Emerson and Thoreau sought this relation in solitude amidst nature, and in their writing. By the 1840s they, along with other transcendentalists, were engaged in the social experiments of Brook Farm, Fruitlands, and Walden; and, by the 1850's in an increasingly urgent critique of American slavery. American literary historians have viewed Ralph Waldo Emerson’s resignation from the Unitarian ministry in 1832 in favor of a literary career as emblematic of a main current in American literature. That current is directed toward the possession of a self that is independent and fundamentally opposed to the “accoutrements of society and civilization” and expresses a Transcendentalist antipathy toward all institutionalized forms of religious observance. In the ongoing revision of American literary history, this traditional reading of the supposed anti-institutionalism of (...) the Transcendentalists has been duly detailed and continually supported. Richard A. Grusin challenges both traditional and revisionist interpretations with detailed contextual studies of the hermeneutics of Ralph Waldo Emerson, Henry David Thoreau, and Theodore Parker. Informed by the past two decades of critical theory, Grusin examines the influence of the higher criticism of the Bible—which focuses on authorship, date, place of origin, circumstances of composition, and the historical credibility of biblical writings—on these writers. The author argues that the Transcendentalist appeal to the authority of the “self” is not an appeal to a source of authority independent of institutions, but to an authority fundamentally innate. American Transcendentalism is a sweeping narrative history of America's first group of public intellectuals, the men and women who defined American literature and indelibly marked American reform in the decades before and following the American Civil War. Philip F. Gura masterfully traces their intellectual genealogy to transatlantic religious and philosophical ideas, illustrating how these informed the fierce theological debates that, so often first in Massachusetts and eventually throughout America, gave rise to practical, personal, and quixotic attempts to improve, even perfect (...) the world. The transcendentalists would painfully bifurcate over what could be attained and how, one half epitomized by Ralph Waldo Emerson and stressing self-reliant individualism, the other by Orestes Brownson, George Ripley, and Theodore Parker, emphasizing commitment to the larger social good. By the 1850s, transcendentalists turned ever more exclusively to abolition, and by war's end transcendentalism had become identified exclusively with Emersonian self-reliance, congruent with the national ethos of political liberalism and market capitalism. Julian Savulescu argues for two principles of reproductive ethics: reproductive autonomy and procreative beneficence, where the principle of procreative beneficence is conceptualised in terms of a duty to have the child, of the possible children that could be had, who will have the best opportunity of the best life. Were it to be accepted, this principle would have significant implications for the ethics of reproductive choice and, in particular, for the use of prenatal testing and other reproductive technologies for the (...) avoidance of disability, and for enhancement. In this paper, it is argued that this principle should be rejected, and it is concluded that while potential parents do have important obligations in relation to the foreseeable lives of their future children, these obligations are not best captured in terms of a duty to have the child with the best opportunity of the best life. Calls to hold artificial intelligence to account are intensifying. Activists and researchers alike warn of an “accountability gap” or even a “crisis of accountability” in AI. Meanwhile, several prominent scholars maintain that accountability holds the key to governing AI. But usage of the term varies widely in discussions of AI ethics and governance. This chapter begins by disambiguating some different senses and dimensions of accountability, distinguishing it from neighboring concepts, and identifying sources of confusion. It proceeds to explore the idea (...) that AI operates within an accountability gap arising from technical features of AI as well as the social context in which it is deployed. The chapter also evaluates various proposals for closing this gap. I conclude that the role of accountability in AI ethics and governance is vital but also more limited than some suggest. Accountability’s primary job description is to verify compliance with substantive normative principles—once those principles are settled. Theories of accountability cannot ultimately tell us what substantive standards to account for, especially when norms are contested or still emerging. Nonetheless, formal mechanisms of accountability provide a way of diagnosing and discouraging egregious wrongdoing even in the absence of normative agreement. Providing accounts can also be an important first step toward the development of more comprehensive regulatory standards for AI. (shrink)

Clinical geneticists are increasingly confronted with ethical tensions between their responsibilities to individual patients and to other family members. This paper considers the ethical implications of a “familial” conception of the clinical genetics role. It argues that dogmatic adherence to either the familial or to the individualistic conception of clinical genetics has the potential to lead to significant harms and to fail to take important obligations seriously.Geneticists are likely to continue to be required to make moral judgments in the resolution (...) of such tensions and may find it useful to have access to ethics training and support. The development of human genetics raises a wide range of important ethical questions for us all. The interpersonal dimension of genetic information in particular means that genetics also poses important challenges to the idea of patient-centredness and autonomy in medicine. How ought practical ethical decisions about the new genetics be made given that we appear, moreover, no longer to be able to appeal to unquestioned traditions and widely shared communitarian values? This paper argues that any coherent ethical approach to these (...) questions must be able both to uphold the moral status of the individual and at the same time recognise the communitarian, interpersonal dimensions both of the world in which we live and of personal autonomy itself. The paper then goes on to propose an approach to the resolution of the ethical questions raised by the use of the new genetics in reproductive choice through the development of a coherent and principled process of public reason and justification oriented towards the support and development of personal autonomy. In "Sider on Existence" (Noužs, 2007), David Liebesman and Matti Eklund argue that my "indeterminacy argument", according to which quantifiers are never vague, clashes with my "naturalness argument", according to which quantifiers "carve at the joints". There is, I argue, no outright inconsistency. But Liebesman and Eklund have shown that my arguments are not as independent as it may have appeared. The best defense of the indeterminacy argument is via the naturalness argument.

I expand modal normativism, a theory of metaphysical modality, to give a normativist account of metaphysical explanation. According to modal normativism, basic modal claims do not have a descriptive function, but instead have the normative function of enabling language users to express semantic rules that govern the use of ordinary non-modal vocabulary. However, a worry for modal normativism is that it doesn’t keep up with all of the important and interesting metaphysics we can do by giving and evaluating metaphysical explanations. (...) So, I advance modal normativism by arguing that metaphysical explanations also have a normative rather than descriptive function. In particular, non-causal explanatory claims have formal and semantic properties that make them expressively stricter than basic modal claims and so are better suited to express fine-grained aspects of semantic rules. A major payoff of my normativist account of metaphysical explanations is that it yields a plausible story about how we come to evaluate and know metaphysical explanations—we do this primarily by conceptual analysis. I also respond to a number of objections, including the objection that the epistemic payoffs of my view are not worth the metaphysical costs. (shrink)

This requirement reflects a principle of general application. Solicitors owe an ethical duty to support the rule of law, including the right to (...) petition. Lawyers without a specific duty to uphold the rule of law have ethical duties to maintain the reputation of the legal system and their legal profession. Lawyers, including solicitors, are frequent contributors to public discourse. Lawyers sometimes resist identifying the clients or client groups they represent in public discourse on the ground of the need to protect client confidentiality. The internet is becoming increasingly important in health care practice. The number of health-related web sites is rising exponentially as people seek health-related information and services to supplement traditional sources, such as their local doctor, friends, or family. The development of e-medicine poses important ethical challenges, both for health professionals and for those who provide clinical ethics support for them. This paper describes some of these challenges and explores some of the ways in which those who provide clinical ethics support (...) might respond creatively to them. By offering ways of responding to such challenges, both electronically and face-to-face, the providers of clinical ethics support can show themselves to be an indispensable part of good quality health care provision. The slogan “the whole is nothing over and above the parts” and related vague thoughts animate many theories of parthood and arguably are central to our ordinary conception. I examine some issues connected with this slogan.

Beauvoir’s The Second Sex stands out as a master class in the accommodation of conceptual and inferential practices to real, objective gender kinds. Or so I will argue. To establish this framing, we will first need in hand the kind of scientific epistemology that correctly reconciles epistemic progress and error, particularly as pertains to the unruly social sciences. An important goal of the paper is to develop that epistemological framework and unlock its ontological implications for the domain of gender. As (...) we will see, the real gender kinds that contemporary social scientists successfully identify and track are very much the same kinds to which Beauvoir was coordinating reference in The Second Sex. The correct identification of those kinds endures as a moral and political priority, regardless of one’s other gender-related normative agenda. (shrink)
